These terms, together with the privacy policy, the acceptable use policy, the SLA and the refund policy, form the whole agreement between you and gpuai.shop. Where documents conflict, these terms take precedence.
You must be 16 or older and able to enter a contract. You are responsible for everything done under your account, including by anyone you give access to. Keep your credentials secure and tell us promptly if they are compromised. One person or organisation per account; do not resell access without a written agreement.
You own everything you put on the service. You grant us only the narrow technical licence needed to store and transmit it in order to operate the platform. We do not access, analyse, disclose or train on your content.
You are responsible for backing up anything you cannot afford to lose. Destroying an instance erases its disks irreversibly.
The acceptable use policy is binding. In short: no illegal activity, no attacks on others, no cryptocurrency mining, no unsolicited email, and nothing that endangers the platform or other customers.
We may suspend or terminate an account that breaches these terms or the AUP, that has an unpaid balance, or that we are legally required to act against. Except where the breach is severe or ongoing harm is being caused, we will contact you first and give you a chance to fix it.
You may close your account at any time. Unused credit is refundable under the refund policy.
The SLA sets out our availability commitment and the service credits payable if we miss it. Those credits are your sole remedy for unavailability.
Beyond what the SLA states and what the law requires, the service is provided as is. We do not warrant that it will be uninterrupted, that it will meet your particular requirements, or that any workload will produce a particular result.
Neither party excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of business, or loss of data. Our total liability in any twelve-month period is limited to the amount you paid us in that period.
You will indemnify us against third-party claims arising from your use of the service in breach of these terms or the AUP.
We will email account holders at least 30 days before material changes take effect. Continuing to use the service after that date means you accept the new terms. If you do not, close your account and claim a refund of unused credit.
These terms are governed by the laws of the jurisdiction in which gpuai.shop is established, and disputes will be heard by its courts. Nothing here removes any mandatory consumer protection you have where you live.
